COLLAR offers and sells, on this website www.collarpainter.com (hereinafter the "Site"), directly to its consumers, products from the Collar collection (hereinafter the “Products” or “Product”). The sale of Products on the Site is subject to these terms and conditions of sale (hereinafter the “Terms of Sale”). The Products displayed on the Site are sold by Collar.

2.1. The Products presented on this Site are offered for sale to consumers, individuals over the age of 18 (hereinafter “Consumers” or “Consumer”) acting for purposes unrelated to any commercial, industrial, entrepreneurial, or professional activities they may engage in. The purchase of Products cannot be made by individuals under 18 years of age without the authorization and supervision of a parent or guardian. COLLAR does not intentionally collect personal information on the Site from or about minors. The purchase of the offered Products will only be possible for shipments to the countries indicated on the Site.

2.2. Before confirming and sending the purchase order, the Consumer must carefully read these Terms of Sale, which can also be reviewed and downloaded from the Site and/or by email that COLLAR will send to the Consumer in accordance with the provisions of Article 3.6 below. The Terms of Sale and the Personal Data Protection Notice (hereinafter “Personal Data Protection Notice”) constitute the provisions governing the contract between the Consumer and COLLAR concluded remotely through the use of the Site.

3.1. The Site provides detailed information on each Product, including images, unit price, technique, and available dimensions. Images are provided for illustrative purposes; COLLAR cannot be held responsible for any inappropriate graphic representation of the Products.

3.2. To purchase a Product, the Consumer must submit a request via the form available on our contact page. Products cannot be purchased directly online on the Site. The request must include details of the desired Product, as well as the name of the artwork, if applicable.

3.3. Upon receiving the request, COLLAR will confirm the availability of the Products and the terms of purchase by email. The Consumer must then follow the provided instructions to finalize the purchase. The General Terms, a summary of essential information about each Product, details of shipping costs, the withdrawal right conditions (“Withdrawal Information Notice”), as well as the Personal Data Protection Notice will be sent to the Consumer for review and acceptance before finalizing the purchase.

3.4. By confirming the request, the Consumer accepts and agrees to comply with these Terms of Sale.

3.5. If the Consumer needs to correct errors in the provided information, they must do so by contacting COLLAR before finalizing the request. By confirming the request, the Consumer acknowledges having reviewed all provided information and accepts the General Terms.

3.6. At the end of the purchasing process, COLLAR advises saving or printing the Terms of Sale, the Personal Data Protection Notice, and the Withdrawal Information Notice. The Consumer will receive an email to the address provided in the request, confirming the order, acceptance of the Personal Data Protection Notice, the Withdrawal Information Notice, and the Terms of Sale, which will be attached to the email. The request will be archived in COLLAR's database in Hanover for at least the time necessary to process orders and, in any case, within the legal timeframes and conditions required by law.

3.7. COLLAR reserves the right to refuse requests from buyers it considers unsuitable or with whom there is a dispute regarding a previous order or for any other legitimate reason, without needing to provide justification. COLLAR also reserves the right to limit or refuse requests that, in its sole discretion, appear to be made for commercial and/or professional purposes.

4.1. COLLAR does not guarantee the availability of items offered on the Site, as they are subject to stock limitations. The Consumer is encouraged to check the availability of items at the time of purchase. Not all references are available online, but a wide selection is offered, with new items being continuously added.

4.2. In the event of temporary unavailability of certain ordered Products, COLLAR will inform the Consumer within 5 business days (and in any case within the delivery timeframe indicated below) by email or phone. If the Product(s) are unavailable, no amount will be charged to the payment method used by the Consumer. If the purchase amount has already been charged, the corresponding amount will be refunded within 30 days.

5.1. The order procedure is completed when the "buy" option is selected. Upon confirmation of the Order Form, the order will be sent to COLLAR for processing and cannot be modified or canceled.

5.2. The confirmation of the order will be considered as proof of the Consumer's acceptance of the provisions in these Terms of Sale, the Personal Data Protection Notice, and the Withdrawal Information Notice. The data recorded by COLLAR on its server will be treated as proof of the transaction concluded between the Consumer and COLLAR.

6.1. The prices of Products available for sale are not directly displayed on the Site. To obtain prices, the Consumer must submit a request via the contact form. Once the request is received, COLLAR will communicate the prices of the requested Products to the Consumer. In case of an error in the price communicated for the Products, COLLAR will offer the Consumer the option to confirm the order again at the correct price or cancel it. If COLLAR is unable to contact the Consumer, the order will be considered canceled.

6.2. The final amount communicated to the Consumer after confirmation of the request will also include shipping costs.

6.3. The Maison offers various secure payment options. Some payment methods may not be available for all orders. We invite you to contact one of our personal advisors for more information.

6.4. Purchased Products will be shipped only after obtaining authorization for debit from the bank. The debit will occur only after the shipment of the ordered Products. COLLAR also reserves the right to verify payment details, including after purchase, in case of anomalies related to the transaction or doubts about fraudulent or unauthorized use of the payment method.

7.1. Products will be delivered to the address provided at the time of filling out the Order Form. For security reasons, COLLAR cannot ship the purchased Product to a post office box or accept orders that do not allow the identification of the recipient and their address.

7.2. Shipping costs are the responsibility of the Consumer and are indicated separately on the Order Form and the corresponding invoice.

7.3. All purchases will be delivered by a chosen courier service (e.g., UPS Express) (hereinafter "Courier Service") between Monday and Friday, excluding Saturday, Sunday, and local or national public holidays, starting from the day after confirmation of the Order Form and, in any case, within 10 (ten) business days from the confirmation of the Order Form, based on the indicated availability. COLLAR is not responsible for unforeseeable delays and/or those attributable solely to the Courier Service.

7.4. In case of issues or delivery delays exceeding 10 (ten) business days from the confirmation of the Order Form, Consumers are requested to inform COLLAR using the email address provided in the "Contacts" section of the Site. COLLAR reserves the right not to respond to claims made more than 30 (thirty) days after the acceptance of the Order Form.

8.1. COLLAR may make changes or corrections to these Terms of Sale, the Privacy Statement and the Products and their prices at any time without notice. The Consumer must carefully check the Terms of Sale and the Privacy Policy each time he or she uses the Website to make a purchase.

8.2. Occasionally, there may be typos, inaccuracies or omissions on the Website (collectively referred to as 'Errors') in relation to the description of the Product, the price, any promotions, offers and availability of the Product. COLLAR reserves the right, at any time and without notice, to correct such Errors, to amend or update information, to revoke any offer containing such Errors, and to cancel any order at any time prior to despatch, including after an order has been submitted and even if the Purchase Order has been confirmed and the relevant amount debited to the payment method used for the purchase.

8.3. The aforementioned changes and/or corrections will only be considered valid for purchase orders sent after the date of the change or correction made by COLLAR. In particular, the Consumer will be charged the prices that appear on the Website at the time of confirmation of the Purchase Order, provided that the Products ordered are available at that time.

9.1. The delivered Products must be checked by the Consumer at the time of delivery to ensure that they correspond to the Products ordered.

9.2. Any anomalies noted at the time of delivery (e.g. alterations or damage to the packaging, damaged Products, items missing from the delivery note, items not conforming to the items ordered, etc.), may be indicated by the Consumer directly to the courier service, by placing a handwritten and signed comment on the delivery note. In this case, the Consumer will not be required to accept the Products and may return them directly to the courier service.

9.3. In the event of anomalies (e.g. alterations or damage to the packaging, damaged Products, items missing from the delivery note, items not conforming to the items ordered, etc.), noted after delivery, the Consumer must inform the courier service as soon as possible in the "Contacts" section of the Site.

10.1. We do not accept returns or refunds on purchased items.

11.1. The Products offered for sale on the Site are provided on an 'as available' basis. COLLAR makes no warranties, express or implied, beyond the description of the Products set out in the Order Confirmation; in particular, COLLAR makes no warranties, express or implied, (i) as to the operation or content of the Site, (ii) that the Site and the servers that host it are free from viruses, or that emails are free from viruses, or (iii) that information collected on the Site is completely secure from access by hackers and other unauthorised users.

COLLAR expressly disclaims any duty to update or revise the materials on the Site. The Consumer assumes full responsibility for any risks associated with the use of the Site.

12.1. All content on the Site www.collarpainter.com such as trademarks, copyrights, corporate images, works, pictures, photos, dialogue, music, sounds, videos, documents, drawings, figures, logos, menus, web pages, graphics, colors, diagrams, tools, typefaces, designs, layouts, methods, processes, functions and software (collectively, the Content), is owned and exclusively available to COLLAR or its content providers and is protected by copyright and other intellectual property laws.

12.2. Consumer may not reproduce, publish, distribute, display, modify, create derivative works from, or in any way exploit, in whole or in part, any of the Content without the prior written consent of COLLAR, or its content providers, as the case may be. Except, however, where COLLAR hereby grants Consumer permission, for its exclusive and non-commercial use, to display, download and print in hard copy the pages of the Site.

12.3. COLLAR has the right at any time to claim ownership of any Content published on the Site and to object to any use, distortion or other modification of that Content.

13.1. COLLAR reserves the right to change, suspend or discontinue the operation of the Site or its contents at any time without notice.

14.1 For any complaint, additional information or assistance on the Site or on the purchase procedure, the Consumer is requested to send an e-mail to the address indicated in the section "Contacts" of the Site.
